Suspensions and Expulsions
General Information: In certain cases, the Dean of Students may suspend or expel a student without action from the Community Court or the faculty meeting.
In cases of sexual harassment, the Dean of Students has this right, as long as the grievance procedure for student sexual harassment (of one student by another) has been followed. (See Policies on Discrimination and Sexual Harassment.)
The Dean may also suspend any student whose misconduct falls within the provisions below, until a student is brought before the Community Court. Failing Court action, the Dean may suspend the student for a period not to extend beyond a single semester. The Dean shall act according to his or her own best judgment, but only after consultation with the convening members of the Dean's Advisory Committee.
The Dean may suspend or expel for any period of time a student whose behavior is described below. Two faculty members of the Dean's Advisory Committee must concur with the Dean on this action.
Reasons for Suspension or Expulsion:
- Behavior which violates the laws of the nation, state, county or town and is repugnant to the standards of the Marlboro Community, in cases where the Community has failed to prosecute;
- Behavior which constitutes a major offense under the Constitution of the Marlboro Community, in cases where the Community has failed to prosecute.
Appeal Process
A student has the right to appeal a Dean's expulsion decision or suspension decision if the suspension is for more than one semester. Notification of the appeal must be in writing to the President and must occur within five working days of the Dean's decision. The President, after reviewing the evidence and consulting with the appropriate parties, may affirm or overturn the expulsion of suspension decision. The President must render a decision within five working days after receiving notification of the appeal.
The President's decision must be in writing to the student and to the Dean.
